These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”) and Hydroxen Solutions (“Company”) governing your access to and use of our website www.hydroxensolutions.in and any services or products offered therein. By accessing our website, you acknowledge that you have read, understood, and agree to be bound by these Terms.
1. Acceptance of Terms
By using this website, you confirm that you are at least 18 years of age, legally capable of entering into binding contracts, and that you agree to comply with these Terms and all applicable laws. If you do not agree to these Terms, you must immediately cease use of this website.
2. Services & Products Offered
Active Services:
Hydroxen Solutions currently provides the following services:
- Reverse Osmosis (RO) Systems — supply, installation, and commissioning
- Water Treatment Plants (WTP)
- Sewage Treatment Plants (STP)
- Effluent Treatment Plants (ETP)
- Boiler Water Treatment
- Cooling Water Treatment
- Maintenance Services — scheduled and breakdown maintenance for all above systems
- Commissioning Services — site commissioning and system startup
- Annual Maintenance Contracts (AMC) and AMC Renewals
Products:
In addition to the above services, Hydroxen Solutions supplies equipment, chemicals, components, water softeners, dosing systems, filtration units, and allied water treatment products based on customer requirements. Product availability is not limited to the categories in which active services are currently offered.
Future Services:
Hydroxen Solutions reserves the right to introduce and expand its service offerings over time. Services not currently listed above may be added without requiring an amendment to these Terms. Such new services shall automatically be governed by these Terms upon being made available.
3. Quotation, Advance Payment & Payment Policy
All service and product engagements are subject to the following payment policy:
- Detailed Quotation: Prior to commencement of any service, Hydroxen Solutions will provide the customer with a detailed written quotation inclusive of service scope, pricing, and applicable GST.
- Quotation Acceptance: Upon acceptance of the quotation by the customer, an advance payment of 50% of the total quoted amount is mandatory before any work is initiated.
- Quotation Rejection: If the quotation is not accepted within the validity period or is not confirmed by the customer, it shall be treated as rejected and no service obligation arises on the part of the Company.
- Balance Payment: The remaining 50% balance must be paid in full upon completion of service, directly to the Company’s officially communicated bank account as stated in the quotation or invoice.
- Official Bank Account Only: Payments made to any account other than the Company’s officially designated bank account will not be acknowledged or accepted. The Company bears no responsibility for payments made to unauthorized accounts, and customers making such payments do so entirely at their own risk.
- GST: All quotations include applicable GST as required under Indian tax laws. Prices listed on the website, if any, are indicative and exclusive of GST unless explicitly stated otherwise.
- Product Purchases: Product sales are governed by individual purchase orders or invoice terms. Payment terms shall be as specified therein.
4. Service Renewal & Proactive Follow-Up
Hydroxen Solutions proactively contacts customers between a few days to one month in advance of service expiry, AMC expiry, or contract renewal milestones to facilitate timely continuation of services. Such communications will be initiated only through our official contact channels — registered phone number or official email.
Customers are advised to verify renewal requests through our official office number if they are in any doubt about the authenticity of a renewal communication.
AMC renewals are subject to revised pricing at the time of renewal and must be confirmed in writing by the customer. The Company is not obligated to continue AMC coverage if renewal is not confirmed and payment is not received prior to expiry.
5. Payment Fraud & Impersonation Warning
Hydroxen Solutions will NEVER solicit payments through unofficial channels, personal bank accounts, or unverified representatives. All official payment requests will be communicated through verified company channels and will reference an official quotation or invoice bearing Company details.
If you receive any call, message, or communication from an individual claiming to represent Hydroxen Solutions and requesting payment:
- Do NOT make any payment without verification
- Immediately contact our official office number to verify the authenticity of such communication
- Report the incident to local law enforcement if you suspect fraud
- Notify us at hydroxensolution@gmail.com so we can take necessary action
The Company holds no liability whatsoever for financial losses incurred by customers as a result of payments made to fraudulent individuals or accounts not officially designated by Hydroxen Solutions.
6. Customer Obligations
For commissioning, maintenance, and AMC services, the customer is responsible for:
- Providing safe, timely, and unobstructed site access to Company service personnel
- Ensuring electrical, plumbing, civil, and infrastructure readiness before commissioning or maintenance work begins
- Notifying the Company of any changes to site conditions, equipment modifications, or third-party interventions that may affect service delivery
- Not tampering with, modifying, or allowing unauthorized persons to service equipment between scheduled maintenance visits
- Ensuring that consumables or parts not covered under AMC are procured as advised by the Company
The Company shall not be held liable for service delays, poor performance outcomes, or equipment damage arising from the customer’s failure to meet the above obligations.
7. AMC Scope & Exclusions
Annual Maintenance Contracts are governed by individually signed AMC agreements specifying scope, visit frequency, response timelines, and inclusions. Unless explicitly stated in the signed AMC agreement, AMC coverage does not include:
- Damage caused by misuse, negligence, tampering, or unauthorized modifications
- Damage due to natural disasters, flooding, power surges, or force majeure events
- Replacement of consumables such as membranes, filters, chemicals, and media unless specifically included
- Repairs arising from failure to follow operating guidelines provided by the Company
Non-payment or delayed payment of AMC charges may result in suspension of AMC coverage without liability to the Company. AMC agreements terminated mid-term due to violation of these Terms will not attract any refund for the unexpired AMC period.
8. Intellectual Property
All content on this website including text, graphics, logos, images, service descriptions, and technical documentation is the exclusive intellectual property of Hydroxen Solutions and is protected under applicable copyright and trademark laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content from this website without prior written consent from the Company.
9. Prohibited Activities
You agree NOT to engage in any of the following activities:
- Unauthorized access, hacking, or attempting to breach the security of this website
- Transmitting viruses, malware, spyware, or any other malicious code
- Scraping, crawling, or data mining without written permission
- Impersonating the Company or any of its representatives
- Using the website for fraudulent, illegal, or unauthorized purposes
- Interfering with or disrupting the website’s servers or network infrastructure
- Attempting to gain unauthorized access to other users’ accounts or data
- Posting defamatory, abusive, threatening, or obscene content
- Violating any applicable local, national, or international law or regulation
10. Force Majeure
Hydroxen Solutions shall not be liable for any delay, disruption, or non-performance of services arising from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, floods, fires, pandemics, governmental actions, power failures, supply chain disruptions, strikes, or civil unrest.
In such events, the Company will make reasonable efforts to notify the customer and resume services at the earliest possible opportunity.
11. Limitation of Liability
Hydroxen Solutions shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use our website or services. Our total liability shall not exceed the amount paid by you for the specific service or product giving rise to the claim.
The Company shall not be held liable for any financial loss arising from payments made to fraudulent individuals or unauthorized bank accounts not officially designated by Hydroxen Solutions.
12. Indemnification
You agree to indemnify, defend, and hold harmless Hydroxen Solutions, its directors, officers, employees, agents, and partners from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of your violation of these Terms, misuse of the website, or infringement of any third-party rights.
13. Legal Action for Violations
Any violation of these Terms, including but not limited to unauthorized access, hacking, data theft, payment fraud, impersonation of Company representatives, defamation, or misuse of our services or website, will result in immediate legal action. The Company reserves the right to:
- File criminal complaints under the Information Technology Act, 2000 and its amendments
- Initiate civil proceedings for damages and injunctive relief in competent courts
- Report violations to law enforcement agencies including the Cyber Crime Investigation Cell
- Pursue recovery of all legal costs, damages, and losses incurred
- Block access to the website and terminate any existing service or AMC agreements without refund
Violators will be prosecuted to the fullest extent of the law.
14. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Patna, Bihar, India. The parties may, by mutual written agreement, opt for arbitration as a first step prior to approaching courts.
15. Termination
The Company reserves the right to terminate or suspend your access to the website at any time, without notice, for conduct that violates these Terms or is harmful to other users, the Company, or third parties.
16. Amendments
We reserve the right to modify these Terms at any time. Your continued use of the website following any changes constitutes your acceptance of the revised Terms.
